Agreement to Terms

By downloading, installing, accessing, or using the Bet Analyser mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Bet Analyser ("we," "us," or "our") governing your use of the App and all related services.

Eligibility Requirements

By using the App, you represent and warrant that:

2. You have the legal capacity to enter into this agreement
3. You are not prohibited from gambling by any applicable law or regulation
4. You are accessing the App from a jurisdiction where online gambling information is legal
5. You will comply with all applicable laws and regulations regarding online gambling in your jurisdiction

Verification

We reserve the right to verify your age and eligibility at any time. If we determine that you do not meet the eligibility requirements, we will terminate your access to the App immediately.

Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for your personal, non-commercial use
• Access predictions and analytics provided by the App

License Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Sell, rent, lease, or sublicense the App
• Use the App for any commercial purpose
• Remove or alter any proprietary notices
• Use automated systems or bots to access the App
• Interfere with or disrupt the App's functionality
• Use the App to violate any applicable laws

Responsible Gambling

We are committed to promoting responsible gambling. We encourage you to:

• Set limits on your gambling activities
• Never chase losses
• Take regular breaks from gambling
• Never gamble while under the influence of alcohol or drugs

Your Responsibility

You acknowledge and agree that:

1. You are solely responsible for your gambling decisions
2. We are not responsible for any losses you may incur
3. Predictions are opinions, not facts
4. You should conduct your own research before gambling
5. You will not hold us liable for inaccurate predictions

Prohibited Activities

You agree NOT to use the App to:

• Violate any applicable laws or regulations
• Engage in fraudulent or deceptive practices
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation
• Upload viruses or malicious code
• Scrape or harvest data from the App
• Use the App for any commercial purpose without authorization
• Impersonate any person or entity
• Promote illegal gambling activities

Enforcement

We reserve the right to:

• Investigate suspected violations of these Terms
• Terminate or suspend your access without notice
• Report illegal activities to law enforcement
• Take legal action against violators

Our Property

All content in the App, including but not limited to:

• Software code and functionality
• Text, graphics, logos, and images
• Predictions and algorithms
• User interface design
• Trademarks and service marks

are owned by or licensed to us and are protected by intellectual property laws.

Limited Use

Your use of our intellectual property is limited to:

• Personal, non-commercial use of the App
• Sharing predictions with attribution
• Fair use as permitted by law

Any other use requires our prior written consent.

User Content

By submitting any content to the App (such as journal entries), you:

• Retain ownership of your content
• Grant us a license to store and display it within the App
• Warrant that you have the right to submit such content
• Agree not to submit infringing or illegal content

Premium Features

Bet Analyser offers premium features through in-app purchases:

• Unlimited predictions access
• Advanced analytics and statistics
• Priority updates and features
• Ad-free experience

Payment Terms

All in-app purchases are:

• Processed through Apple's App Store
• Subject to Apple's payment terms and conditions
• Non-refundable except as required by law
• Charged to your Apple ID account

Subscriptions

If you purchase a subscription:

• It will automatically renew unless cancelled
• You can cancel anytime through App Store settings
• Cancellation takes effect at the end of the current period
• No partial refunds for unused portions

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION

Maximum Liability

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is less.

Exceptions

Some jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Your Indemnification Obligations

You agree to indemnify, defend, and hold harmless Bet Analyser, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

1. Your access to or use of the App
2. Your violation of these Terms
3. Your violation of any third-party rights
4. Your violation of any applicable laws
5. Any gambling activities based on our predictions
6. Any content you submit to the App

Procedure

We will:

• Notify you of any claim subject to indemnification
• Allow you to control the defense (with counsel acceptable to us)
• Cooperate in the defense at your expense

Termination by You

You may terminate this agreement at any time by:

• Deleting the App from your device
• Cancelling any active subscriptions
• Ceasing all use of the App

Termination by Us

We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including if you:

• Breach these Terms
• Violate applicable laws
• Engage in prohibited uses
• Provide false information
• Fail to meet age requirements

Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must cease all use of the App
• All data stored locally remains on your device
• Provisions that should survive termination will remain in effect

Governing Law

These Terms shall be governed by and construed in accordance with the laws of US, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in US.

Dispute Resolution

Any disputes arising from these Terms shall be resolved through:

1. Good faith negotiations between the parties
2. If negotiations fail, binding arbitration under [Arbitration Rules]
3. Small claims court for qualifying disputes

You waive any right to a jury trial or to participate in a class action.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bet Analyser regarding the use of the App and supersede all prior agreements and understandings.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Updates to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after changes constitutes acceptance of the modified Terms.
